From Checkout to Courtroom: Winning the Fight Against Retail Crime
Retail crime is no longer simply a series of isolated theft incidents.
Increasingly, prosecutors are encountering coordinated, profit-driven networks operating across jurisdictions, online marketplaces, retail locations, and organized resale channels. What initially appears to be a routine theft case may actually reflect a broader system of coordinated criminal activity involving repeat offenders, fencing operations, digital marketplaces, and structured methods of monetization.
Yet many cases are still approached through an incident-based lens — limiting both investigative strategy and prosecutorial impact.
Recognizing patterns early — and understanding how those patterns connect — is essential. NDAA’s 2026 Retail Crime Conference is designed to support that work.
This is not a theoretical program. It is a practical, prosecutor-focused training built around how organized retail crime networks are identified, investigated, structured, and prosecuted in real conditions — across jurisdictions, agencies, and investigative systems.
Participants will examine how retail crime operations evolve over time, how coordinated activity is identified, and how stronger investigative and charging strategies can better reflect the full scope of criminal conduct.
What You Will Do in This Program
This program combines strategic instruction with practical application so participants can move beyond reactive charging and toward more comprehensive, network-based prosecution strategies.
Throughout the program, you will:
- Identify indicators of organized retail crime networks across seemingly unrelated incidents
- Examine how fencing operations and resale structures function within broader criminal systems
- Analyze how online marketplaces and digital platforms influence investigations
- Develop strategies for building stronger, multi-incident prosecutable cases
- Explore aggregation, enterprise, conspiracy, and coordinated charging approaches
- Strengthen collaboration across retailers, investigators, prosecutors, and multidisciplinary partners
But just as important as the content is the room.
A Room Built for Strategic Case Development
This program is designed for prosecutors and multidisciplinary partners actively handling retail theft, organized crime, enterprise investigations, and complex criminal activity.
Participants learn alongside peers from across the country, examining how different jurisdictions are responding to evolving retail crime trends — what strategies strengthen cases, where investigations break down, and how coordinated approaches improve prosecutorial outcomes.
Sessions emphasize practical application, connecting investigative decisions to charging strategy, coordination, and long-term case development.
You will not simply discuss organized retail crime.
You will examine how networks operate — and how stronger prosecutorial strategies can better disrupt them.
Course Structure
Day 1: Understanding the Network
Examine how organized retail crime networks function, including fencing operations, online marketplaces, retailer intelligence, and network-based case identification.
Day 2: Building the Case
Focus on multi-jurisdictional coordination, charging strategy, applied case development, juvenile considerations, and prosecutable network construction.

Eligibility
NDAA’s mission is to serve and support prosecutors and their staff. In consideration of this commitment, NDAA requires that all attendees currently work in or work closely with prosecution.

All registration cancellations and refund requests must be made 30 calendar days prior to the first day of the NDAA event to receive a full refund. Full refunds cannot be approved for requests received after this date. Should you need to cancel your registration less than 30 days but more than 14 days before the event, a 75% refund will be granted with a written request. NDAA regrets that refunds/credit will not be given for cancellations within 14 days of the event or for no-shows. However, substitutions are gladly accepted at any time. Should another office member want to attend the course in your place please contact training@ndaajustice.org.

NDAA will apply for CLE credit in Illinois, Kansas, Mississippi, Missouri, Ohio, Pennsylvania, Tennessee, Texas, and Virginia based on state requirements and guidelines. All other attorneys seeking CLE credit should contact their state bar for more information. At the conclusion of the course and after completion of the electronic evaluation survey, all attendees will receive a uniform continuing education certificate that they may use to report their continuing education hours to their state bar or reporting agency.
