Artificial intelligence is transforming prosecution on two fronts simultaneously: as a powerful tool for managing digital evidence and as a growing source of evidence itself. Prosecutors today face unprecedented volumes of data from mobile devices, cloud platforms, body-worn cameras, social media, and other digital sources. AI can help collect, prioritize, and surface relevant and potentially exculpatory information faster and more efficiently than traditional manual review methods.
At the same time, AI-generated and AI-assisted content—including synthetic media, algorithmic analyses, and chatbot interactions—is increasingly appearing in investigations and litigation. Courts are beginning to address critical questions surrounding the discovery, preservation, authentication, and admissibility of this emerging category of evidence.
This webinar explores both dimensions of AI's role in modern prosecution. The first half focuses on the practical application of AI in eDiscovery and evidence-management workflows, highlighting strategies to leverage AI while maintaining defensibility through validation, transparency, and human oversight. The second half examines the evidentiary challenges posed by AI-related evidence, including authentication, chain of custody, discovery obligations, and the role of AI in forensic tools and examinations.
Attendees will gain a practical framework for integrating AI into prosecutorial workflows and a better understanding of the legal and evidentiary considerations that accompany AI-generated and AI-assisted evidence. The central takeaway is clear: AI can help uncover the truth, but it cannot be permitted to determine it.
Key Takeaways:
  • Apply AI within eDiscovery and evidence-management workflows while maintaining defensibility.
  • Establish validation and human-review processes that support consistent, repeatable results.
  • Understand evolving discovery, preservation, and chain-of-custody obligations involving AI-related evidence.
  • Evaluate the authentication and admissibility challenges associated with AI-generated and AI-assisted evidence.
  • Distinguish between appropriate and inappropriate uses of AI within forensic investigations and expert testimony.
  • Develop practical strategies for the responsible incorporation of AI into prosecutorial practice.
